Terms of Service

1.Who these terms are with
These terms are an agreement between you and Ballast (ballast.to) ("Ballast", "we"). They cover the website, the dashboard, the REST API and the MCP server. By creating an account or using Ballast you accept them, together with the Acceptable Use Policy, the Privacy Policy and the Data Processing Agreement, which are part of these terms.
If you accept on behalf of a company, you confirm you may bind it, and "you" means that company.
2.Business use only
Ballast is for businesses and professionals sending one-to-one outbound email for their work. You must be at least 18 and act for a business, not as a consumer. Consumer protection rules that apply only to consumers do not apply to this agreement, as far as the law allows.
3.Accounts, workspaces and access
You need an account with a working email address. Each account can own or join workspaces; a workspace holds mailboxes, leads, campaigns and replies. Seats are unlimited. The workspace owner decides who joins and with which role (owner, admin or member).
- You keep your password, API keys and connected apps safe. Anything done with them counts as done by you.
- When you connect an AI assistant over MCP or the API, it acts with your role in that workspace. Sending, importing and deleting ask for a confirmation first, but what you approve is your responsibility.
- Tell us at contact@ballast.to if you think someone else has access to your account.
4.Plans, billing and refunds
Dodo Payments is our merchant of record. When you subscribe, you buy from Dodo Payments, which charges your card, issues the invoice and handles sales tax and VAT. Their terms apply to the payment.
- Every plan has every feature. Plans differ by emails per month and active contacts. Prices and limits are shown before checkout and in Settings, Billing.
- A card is required. There is no free plan.
- Subscriptions renew each month or each year until cancelled. You can cancel at any time in Settings, Billing; the plan stays active until the end of the period you paid for.
- When a workspace reaches its monthly email limit, sending pauses until the next period or until you change plan. We do not charge for extra emails.
- Refunds: ask at contact@ballast.to within 3 days of a charge and we refund it in full, no questions asked. After 3 days, payments are not refunded, except where the law requires it.
- We may change prices with 30 days' notice by email. A new price applies from your next renewal after the notice ends.
- If a payment fails, the workspace can still sign in to fix billing, but sending stops until the plan is active again.
5.Your mailboxes and your emails
Ballast sends from mailboxes you connect: your Google Workspace, Microsoft 365, Outlook.com or other accounts. You are the sender of every email and the controller of the lead data you bring. You are responsible for:
- having a lawful basis to email each person, such as legitimate interest for relevant business outreach, and following the rules where they are (for example GDPR and ePrivacy rules in the EU and UK, CAN-SPAM in the US, CASL in Canada);
- following the terms of your mailbox providers, including their sending limits;
- the content of your emails, which must be truthful and say who you are;
- honouring every opt-out. Ballast puts an unsubscribe option in every campaign and suppresses the address in your workspace for good; you must not work around it.
Nobody controls Gmail's or Microsoft's filters. We do not promise that any email reaches the inbox, gets a reply or produces a sale.
6.Limits that protect everyone
Some limits are part of the service and cannot be turned off. They protect your domains, the people you email and the platform:
- For its first 7 days, a workspace can connect at most 5 mailboxes and send at most 1,000 emails a day.
- New mailboxes ramp up slowly, and each mailbox sends no more than its daily limit, with a random gap between emails.
- Campaigns pause when bounces climb. A workspace pauses above a 8% bounce rate, whatever its own setting.
- Suppressed, unsubscribed and bounced addresses are never emailed again from that workspace.
We may change these limits to keep the service safe. We will not tighten them in a way that stops normal, compliant use without telling you first.
7.Your data
Your leads, copy, replies and settings are yours. You give us permission to store and process them only to run Ballast for you, as described in the Data Processing Agreement. We do not sell them, share them for advertising or use them to train AI models.
You confirm you have the right to upload the data you bring, and that it was not collected in breach of the law or of the Acceptable Use Policy.
8.AI features
Write with AI drafts copy and an offer profile; reply labels sort replies when a workspace turns them on. Drafts arrive switched off and nothing is sent without you. AI output can be wrong: read it before you use it. The providers that run these features are listed on the sub-processors page.
AI features have fair use limits, shown in the app when you reach them.
9.Services you connect
Mailbox providers, email verifiers, webhook endpoints, AI assistants and your own AI keys are services you choose and connect with your own account. Their terms apply between you and them. We are not responsible for them, and when one changes or stops working, the matching part of Ballast may stop too.
10.Suspension
We may pause campaigns, limit sending or suspend a workspace or account when we reasonably believe it breaks these terms or the Acceptable Use Policy, or puts other customers, recipients or the service at risk. When we can, we tell you first and give you a chance to fix it. When harm is ongoing (phishing, for example), we act first and tell you after.
Serious or repeated breaches end the agreement, without a refund for the current period.
11.The service
We work to keep Ballast running and your data safe, but we do not promise it will be uninterrupted or free of errors. We may change, add or remove features; if we remove one you rely on in a way that matters, we tell you in advance.
The API and MCP server have rate limits. Do not use them, or the free domain checker, to overload the service or to scan domains you have no reason to check.
12.Our software
Ballast, its code, design and name belong to us. You may use the service while your subscription is active; you may not copy, resell or reverse engineer it, or use it to build a competing product. Feedback you send us may be used freely.
13.Warranties and liability
Ballast is provided "as is", without warranties beyond those these terms state, as far as the law allows.
Neither side is liable for lost profits, lost revenue, lost data that could have been kept by reasonable backups, damage to sender reputation, or indirect or consequential losses. Each side's total liability under this agreement is limited to the amount you paid for Ballast in the 12 months before the event. These limits do not apply to fraud, to damage caused on purpose or by gross negligence, or where the law does not allow them.
You will cover us against claims from third parties (recipients, mailbox providers, authorities) caused by the emails you send, the data you upload or your breach of these terms or the Acceptable Use Policy.
14.Ending the agreement
You can cancel your plan at any time. To close your account or a workspace, write to contact@ballast.to. We may end the agreement with 30 days' notice, or at once for a serious breach.
After an account or workspace is closed, we delete its data within 30 days, and it leaves our backups within 30 more. Ask before closing if you want a copy of your leads. Billing records stay with Dodo Payments for as long as tax law requires.
15.Changes to these terms
When we change these terms in a way that matters, we email account owners at least 30 days before the change applies. Using Ballast after that date means you accept the new terms; if you do not, cancel before then.
16.Law and disputes
These terms are governed by the laws of Romania. Disputes go to the competent courts of Romania, unless the law gives you a different choice. If one part of these terms is invalid, the rest still applies. Write to contact@ballast.to first: most problems are faster to solve by email.
